AT THE ONBOARD RESPONSIBILITY, I ACKNOWLEDGE HAVING READ, UNDERSTOOD, AND ACCEPTED THE FIVE PARAGRAPHS BELOW RELATING TO SAFETY AND NAVIGATION.
1/ That all instructions concerning safety on board, as outlined by the ship's captain, have been well understood.
2/ That this boat conforms to the reservation made, and that the number of passengers does not exceed the authorized limit of 10 persons.
3/ That as the renter of the boat during the period stipulated in the contract, my responsibility is fully engaged regarding actions on board the ship and behaviors toward the captain and other users and renters.
4/ That I have been advised by SAS SAFLOT or by its representatives that the use of a boat could involve significant risks and that I have been informed accordingly of the safety measures to be observed for a safe practice of this activity.
5/ Consequently: I release the company SAFLOT and its representatives from any liability regarding the use of the vessel and its accessories or damages to this boat caused by a renter or by myself and accept all risks inherent to the practice of this activity. Furthermore, I commit to indemnify the company SAFLOT and its representatives from all lawsuits or claims arising from the above-accepted contract and the use of the rented boat mentioned above.
General rental conditions and clauses
Article 1. OBJECT OF THE CONTRACT
The purpose of this contract is to provide a boat. The identification of the lessor, the tenant, the boat, the price, and the rental period will be mentioned in the particular conditions of the contract.
The signature of the particular conditions by the tenant constitutes acceptance of the general conditions of the contract.
Article 2. PAYMENT TERMS
For a booking, the payment for the rental is made in a single payment via bank transfer or secure payment on the ship's website.
Without news from the tenant and without full payment on the planned day for taking possession, the contract will be terminated due to the tenant's default, and the sums previously paid will be acquired as a matter of right by the owner or the lessor as termination compensation without the need for any formal notice. The tenant must pay 100% of the rent and the APA before the beginning of the rental.
Article 3. TAKING POSSESSION OF THE BOAT
The provision of the boat for the tenant is effective once the following formalities are completed:
a) The rent is fully paid,
b) APA (Advance Provisioning Allowance) must be paid at the same time as the rent. The remaining amount of the APA will be refunded to the tenant within 48 hours after the end of the rental. The APA, initially intended to cover fuel and any extra costs, can also be used to pay for damages caused to the boat by the tenant.
c) The tenant must provide the lessor with a copy of an ID in their name.
d) The tenant has communicated the complete list of the identities of the people on board, which also includes their agreement to the provisions of this contract considered particularly important for their safety. The taking possession of the boat cannot, under any circumstances, be carried out if the above formalities have not been completed. At the time of taking possession of the boat, the tenant agrees to accept the vessel in its current state. No mechanical or other guarantee applies to the vessel made available to the tenants.
Article 4. OBLIGATIONS OF THE LESSOR
The lessor must provide the tenant with a boat that is suitable for navigation, equipped in accordance with the laws and regulations in force in the country of the lessor. The tenant will have free use of a docking place for at least the first and last day of the rental.
Article 5. OBLIGATIONS AND RESPONSIBILITY OF THE TENANT
By signing this contract, the tenant agrees to:
-Not possess a weapon on board.
-Not possess or consume drugs on board.
-Not be in possession of more than 10,000 euros in cash.
If the tenant breaches these three rules, they will assume all consequences before the French courts and release the captain of the vessel from any responsibility related to these infractions.
The tenant agrees to use the boat in a "good family man" manner, complying with the regulations of the French authorities and the instructions of the captain. The tenant is responsible for all their actions and those of their guests.
Every hour of delay will entitle the company to compensation equivalent to €200.00 per hour begun.
The tenant retains responsibility for the boat and its equipment. The captain is solely responsible for all damages resulting from their actions. The boat is returned to the lessor in the condition in which it was entrusted to them. The rental will only end after the return of the boat to the company under the conditions specified above. If the condition of return is satisfactory, the APA will be refunded to the tenant.
Article 6. PURPOSE AND RETURN OF THE APA
The APA is intended to guarantee: -the deterioration, loss, or theft of the boat or its equipment, which are not covered by insurance, but especially to cover fuel costs for the day.
At the end of the rental day, if no damage is found, the customer will be refunded the excess APA after refueling. If the APA do not cover the fuel costs, an invoice will be sent to the tenant.
Article 7. INSURANCE
The lessor has taken out an insurance policy covering all damages that may occur to the boat and, more specifically, loss due to damage, total theft of the boat, partial theft of the boat's accessories, as well as liability insurance. This insurance includes a deductible that will be the tenant's responsibility. The theft and loss of personal effects of the people on board, as well as accidents they may suffer, are not covered by the above-mentioned insurance.
Article 8. ACCIDENTS, DAMAGES
In the event of an accident, malaise, loss of materials, or any other incidents, the tenant must, under penalty of losing the benefit of the insurance, imperatively and immediately notify the captain of the vessel.
Article 9. TERMINATION OF THE CONTRACT
Before taking possession of the boat, the tenant may terminate this contract by paying the following amounts:
-Termination more than three months before departure: 500 Euros.
-Termination less than 90 days before departure: 25% of the rental amount.
-Termination less than 60 days before departure: 100% of the rental amount.
Unfavorable weather is not a valid reason for termination; only a Special Weather Bulletin can cancel a rental and lead to a refund for the tenant.
Article 10. DISCLAIMER OF LIABILITY
The responsibility of the lessor cannot be questioned for damages suffered by the tenant and/or any third party using the boat in any capacity whatsoever and/or engaging in any other ancillary activity during the rental period.
The lessor cannot be held responsible for the loss or damage suffered by the tenant's belongings and/or those of third parties left on board.
Article 11. MISCELLANEOUS PROVISIONS
It may be necessary, for reasons of regulations specific to the lessor's country, for the tenant to have on board their rental contract written in the language of the host country.
In this case, the lessor will have to have a new copy of the contract signed by the tenant, but only the first signed contract will have the force of law between the parties. This contract is subject to the law applicable in the lessor's country. Any disputes with a tenant will be the exclusive jurisdiction of the courts of Draguignan.
The tenant must be aware of and accept the 5 paragraphs relating to safety and navigation at the time of taking possession of the boat, chapters clearly defining compliance with regulations and the safe use of a pleasure vessel.
Article 12. OVERSTAY OF RENTAL TIME
Any return to the port at the dock after 6 PM will be charged an additional fee of €200 including tax per additional hour.
Article 13. FUEL SUPPLEMENT
The fuel supplement will be done after the rental by the captain. Following the supplement, the excess APA will be transferred directly to the client’s account. If the APA do not cover the fuel costs, an invoice will be sent to the tenant afterward.
